This Agreement contains the terms under which Dominate Local LLC dba BlueSendr (“we,” “our,” or “us”) licenses the BlueSendr macOS application and explains how we collect, use, and protect information. BlueSendr is a locally installed software product that bridges a user’s macOS iMessage application with compatible CRM platforms.

By installing, activating, or using BlueSendr, you agree to all terms in this document. If you do not agree, do not use the Software.


1. License Grant

We grant you a non-exclusive, non-transferable license to install and use BlueSendr on your own macOS device for your internal business or personal use.
This license does not transfer ownership.
You may not copy, distribute, sublicense, resell, or reverse-engineer the Software.


2. Licensing Options

2.1 Monthly License

• Recurring monthly fee
• Includes updates and support while your subscription remains active

2.2 Lifetime License

• One-time payment
• Includes one year of updates and support
• Continued updates or support after the first year require a renewal
• You may use the version purchased indefinitely


3. Software Updates

Updates are released at our discretion and may include feature improvements, bug fixes, or compatibility changes.
Access to updates depends on your active monthly subscription or your support window under a lifetime license.


4. Interaction With iMessage and CRMs

BlueSendr operates on your device to facilitate message sending via your iMessage account.
We do not operate a messaging service and have no control over Apple infrastructure or CRM platforms.

You are responsible for:
• Your Apple/iMessage account and credentials
• Your CRM accounts and API keys
• All message content you send
• Compliance with all messaging regulations and consent requirements

BlueSendr does not host, store, or transmit your messages off of your device.


5. User Obligations

You agree not to:
• Reverse engineer, decompile, or modify the Software
• Attempt to remove or bypass license controls
• Use the Software for spam, unlawful messaging, or abusive behavior
• Circumvent Apple’s technical or policy restrictions
• Misuse the Software in ways that violate messaging or privacy regulations

You are responsible for actions taken through the Software installed on your device.


6. Limitations, Availability, and Data Behavior

Because BlueSendr depends on Apple iMessage, CRM APIs, and local macOS conditions, we cannot guarantee:
• Message deliverability
• Software uptime
• Compatibility with future macOS or iMessage updates
• Absence of errors or interruptions

All message content processed through the Software stays on your macOS device.
We do not access or store message bodies, attachments, or iMessage metadata.


7. Support

Monthly license users receive support while subscribed.
Lifetime license users receive one year of support from purchase.
Support is offered via our designated channels.


8. Refunds

All payments are final unless required by law.
Monthly licenses may be canceled anytime but remain active until the end of the billed period.
Lifetime licenses are non-refundable.


9. Termination

We may terminate your license if you:
• Violate this Agreement
• Abuse the Software
• Engage in unlawful or harmful behavior

Upon termination, you must discontinue use and remove the Software from your device.


10. Disclaimer of Warranties

BlueSendr is provided “as-is.”
We do not guarantee uninterrupted operation, error-free performance, or compatibility with future systems.

You assume all risks associated with using the Software.


11. Limitation of Liability

To the fullest extent allowed by law, we are not liable for:
• Loss of profits, revenue, or data
• Regulatory or compliance penalties
• Messaging failures or delivery issues
• Business interruption or damages
• Any indirect or consequential losses

Our total liability is limited to the amount paid for your most recent license purchase.


12. Information We Collect

We collect only what is necessary to operate the Software and manage licenses.

12.1 Information You Provide

• Name
• Email
• Payment info (via third-party providers)
• License activation data
• Support requests or correspondence

12.2 Technical and Diagnostic Data

We may collect limited system or diagnostic information such as:
• Device type and macOS version
• License key activity
• Error logs
• Performance data

12.3 iMessage Data

We do not:
• Access or store message content
• Transmit message content outside your device
• Access your Apple ID credentials
• Store attachments, media, or message metadata
• Sync your iMessage logs to our servers

12.4 CRM-Related Data

Any CRM API keys or configuration details remain stored locally.
We do not store or transmit CRM data unless essential for licensing or debugging.


13. Website and Analytics

Our website may collect basic analytics data:
• IP address
• Device/browser info
• Referrals
• Pages viewed
• Cookie identifiers

We do not use analytics to track message content or user behavior inside the Software.


14. How We Use Information

We use collected information to:
• Validate licenses
• Provide and improve the Software
• Offer support
• Communicate important updates
• Prevent fraud or abuse
• Comply with legal requirements

We do not sell personal information.


15. How We Protect Information

We implement reasonable security controls, including:
• Encryption where appropriate
• Access restrictions
• Secure payment processing via third parties
• Minimization of stored personal data

No method of electronic storage is completely secure.


16. Sharing of Information

We may share limited information only with:
• Payment processors
• License management tools
• Customer support or hosting providers
• Legal authorities when required
• Successor entities during business transfers

We do not sell or rent your information to advertisers or data brokers.


17. Data Retention

We retain:
• License records as long as required for operational or legal reasons
• Support communications as needed
• Diagnostic logs only as long as needed to improve the Software

We never retain iMessage content.


18. International Users and Privacy Rights

Users in certain jurisdictions (e.g., GDPR regions) may have the right to:
• Access personal data
• Request correction or deletion
• Restrict processing
• Request portability
• Object to certain uses

We may require identity verification.


19. Children’s Use

BlueSendr is not intended for individuals under 18.
We do not knowingly collect information from minors.


20. Cookies and Tracking Technologies

Our website may use cookies for authentication, analytics, or preferences.
You may disable cookies via your browser, though some features may not function properly.


21. Third-Party Platforms and Integrations

BlueSendr interacts with:
• Apple iMessage
• Your chosen CRM platforms

Each third-party platform has its own terms and privacy policies.
You are responsible for understanding and complying with these third-party requirements.

We are not responsible for:
• CRM outages
• Apple infrastructure failures
• Carrier filtering or delivery behavior
• Regulatory violations caused by your message content


22. No Access to Message Content

For clarity:

We do not store, transmit, analyze, or collect the content of messages sent through iMessage.
Message content stays entirely on your macOS device.

25. Governing Law
